La direttiva 35 varata nel 2005 dalla Commissione Europea prevedeva in sostanza una multa, ora chi scarica illegalmente in mare non solo pagherà di più ma rischierà anche il carcere. Dal 27 marzo, le violazioni alle norme esistenti potranno quindi essere considerate di rilevanza penale e sanzionate con provvedimenti penali: gli stati membri saranno obbligati a garantire che le imprese siano considerate responsabili di azioni inquinanti a danno del mare atte a procurare loro un vantaggio, oltre a garantire una politica di sanzioni efficaci e dissuasive. L’Italia ha già introdotto nel proprio ordinamento la direttiva UE.
